Terms of Use (ComfortPoints)

THE COMPANY RESERVES THE RIGHT TO AMEND THE TERMS AND CONDITIONS AT ANY TIME AND FROM TIME TO TIME WITHOUT NOTICE TO THE COMFORTPOINTS MEMBER.

COMFORTDELGRO COMFORTPOINTS IS NOT TARGETED TOWARDS, NOR INTENDED FOR USE BY, ANYONE UNDER THE AGE OF 13. IF YOU RESIDE IN SINGAPORE AND ARE BETWEEN THE AGES OF 13 AND 18, AT THE TIME OF APPLICATION, YOU MAY ONLY USE COMFORTDELGRO COMFORTPOINTS UNDER THE SUPERVISION OF A PARENT OR LEGAL GUARDIAN WHO AGREES TO BE BOUND BY THESE TERMS OF USE. SINGAPORE IDENTITY CARD, SINGAPORE PERMANENT RESIDENT CARD, WORK PERMIT AND PASSPORT MAY BE REQUIRED DURING REGISTRATION.

IT IS THE SOLE RESPONSIBILITY OF THE COMFORTPOINTS MEMBER TO REFER TO THE WEBSITE AT HTTP://WWW.COMFORTPOINTS.COM.SG. REGULARLY FOR THE LATEST AND PREVAILING VERSION OF THE TERMS AND CONDITIONS.

The Terms and Conditions governing the use of, and the ComfortPoints member’s participation in the ComfortDelGro ComfortPoints Programme (the “Programme”) are listed below. The Programme is run and managed by Comfort Transportation Pte Ltd and CityCab Pte Ltd (the “Company”). By registering and using the ez-Link or FlashPay Card (“Card”) for this Programme, the ComfortPoints member is deemed to have read, understood, accepted and be bound by all the Terms and Conditions herein.

In this Terms and Conditions, the definition of the terms are set out below, except where the context otherwise requires:-

    1. “Account” refers to the ComfortPoints account which can register up to maximum 2 ez-Link or FlashPay cards.
    1. “ComfortPoints” refer to the points issued to the ComfortPoints member in the ComfortDelGro ComfortPoints Programme.
    1. “ComfortPoints member” refers to the registrant of ComfortPoints.
    1. “ComfortPoints portal” refers to the ComfortDelGro ComfortPoints website at http://www.comfortpoints.com.sg.
    1. “Card” refers to the registered ez-Link or FlashPay card.
    1. “Cashless” refers non-cash payment modes, including credit, debit and stored value cards, accepted on the Company’s taxis.
    1. “Company” refers to Comfort Transportation Pte Ltd and CityCab Pte Ltd.
    1. “Eligible Spent” refers to the cashless taxi transportation transactions paid by ComfortPoints member.
    1. “Partners” refers to a person or third party or an entity of the Company that participates in the Programme.
    1. “Programme” refers to the ComfortDelGro ComfortPoints Programme managed by Comfort Transportation Pte Ltd and CityCab Pte Ltd.
    1. “Reward” refers to the products and/or services redeemable by the ComfortPoints member in exchange for his ComfortPoints.
    1. “Service Provider” refers the Comfort Transportation Pte Ltd and CityCab Pte Ltd.
    1. “Taxis” refer to ComfortDelGro fleet of taxis.
  1. “Working hours” refers to the working hours of Comfort Transportation Pte Ltd and CityCab Pte Ltd.

Unless the context otherwise requires, words importing the singular shall also include the plural and vice versa. Words denoting the masculine gender include the feminine gender and both shall include the neuter gender.

Unless the context otherwise requires, words referring to the singular number shall include the plural number and vice versa. Headings are used for ease of reference only. The Terms and Conditions herein contained are not to be interpreted by reference to the heading.

1.1 The Programme is the sole property of the Company.

1.2 The Terms and Conditions of the Programme (and the ComfortPoints member’s participation thereof) is determined and governed by the Company.

Successful registration will automatically enrol ComfortPoints members to the Programme. The Company hereby reserves the right to determine, at its sole and absolute discretion, the eligibility of the ComfortPoints member’s participation in the Programme.

Upon successful registration, the ComfortPoints member is deemed to have fully accepted and agreed to all these Terms and Conditions of the Programme.

4.1 The ComfortPoints member will earn 5 ComfortPoint for every S$1 Eligible Spent for all successful payments done onboard ComfortDelGro taxis unless otherwise stated.

4.2 For taxi booking trips,

    • 4.2.1 The ComfortPoints member must make the completed taxi booking trip through any of the booking channels owned by the Company.
    • 4.2.2. The completed taxi booking trip refers to a successful taxi booking.

4.3 For each Eligible Spent, ComfortPoints earned will be rounded off to the nearest dollar. For instance, if a ComfortPoints member spends S$10, he/she will receive 50 ComfortPoints. If he/she spends S$10.90, he/she will receive 55 ComfortPoints (rounded up from 54.5 ComfortPoints).

4.4 The Company hereby reserves the right to, at any time, and from time to time, impose a limit on the number of ComfortPoints to be awarded to each ComfortPoints member in respect of special promotional items and/or offers.

4.5 The Company shall be entitled, at any time, to cancel any ComfortPoints awarded if the Eligible Spent to which such award relates to are returned or cancelled for any reason, and a full refund of the Eligible Spent is given.

4.6 ComfortPoints will only be awarded to ComfortPoints members who personally make the Eligible Spent. The Company reserves the right to refuse, without assigning any reason whatsoever, to award any ComfortPoints to the ComfortPoints member, until the Company is fully satisfied as to the verification of the ComfortPoints members identity.

4.7 Without prejudice to all the Terms and Conditions stated herein, in relation to Eligible Spent made by persons other than the ComfortPoints member (whether authorised by the ComfortPoints member or not), the Company may, without notice to the ComfortPoints member, delete any of the ComfortPoints from the ComfortPoints member’s account which has been awarded.

4.8 ComfortPoints are non-transferrable and shall not be transferred between accounts even if the accounts belong to the same individual.

4.9 The ComfortPoints member shall notify and provide relevant supporting documents (if applicable) to the Company no later than 7 working days from the trip date of the disputed ComfortPoints to enable us with the dispute resolution.

4.10 The Company shall be entitled, at any time, to deny the right or delay the recovery of the disputed ComfortPoints if the grounds of dispute are undetermined.

4.11 ComfortPoints will be credited to the ComfortPoints member’s account upon successful completion of a booked/paired trip.

4.12 ComfortPoints shall be entitled only to redeem Rewards under the Programme.

4.13 The Company reserves the right to refuse or reject to award any ComfortPoints for transactions at its sole and absolute discretion and the ComfortPoints member shall not be entitled to any compensation or payment whatsoever.

4.14 The Company reserves the right to cancel or void any ComfortPoints awarded in a ComfortPoints member’s account at its sole and absolute discretion and the ComfortPoints member shall not be entitled to any compensation or payment whatsoever.

5.1 Only ComfortPoints member(s) shall be entitled to redeem Rewards under the Programme.

5.2 Only ComfortPoints members who make 1 valid trip with ComfortDelGro Taxis will be entitled to make a gift redemption.

5.3 The ComfortPoints member may redeem Rewards via the ComfortDelGro Taxi Booking App or such redemption channel as the Company may from time to time inform. The redemption shall be deemed to be duly made by the ComfortPoints member upon confirmation of the reward. The ComfortPoints member agrees that the use of any particular channel shall be governed by the terms and conditions then in force.

5.4 The list of Rewards and the number of ComfortPoints required for the redemption of the Rewards shall be determined by the Company in its absolute discretion at any time and from time to time. For the avoidance of doubt, the Company may, from time to time, and at any time, amend the ComfortPoints required for redemption of Rewards without notice to ComfortPoints members.

5.5 No cancellation or change is allowed on the Reward redemption item once ComfortPoints member has submitted the request.

5.6 ComfortPoints cannot be reinstated upon redemption.

5.7 ComfortPoints/Promo Code/Redemption item(s) is/are not exchangeable for cash. Participating merchants reserve the right to substitute any item with another of equivalent value.

5.8 We shall not be liable whether directly or indirectly for any damage, injury, loss whatsoever, howsoever incurred or suffered to a person as a result from the redeemed products or services. The ComfortPoints member shall not be entitled to any compensation or payment whatsoever.

5.9 The Company’s decision on all matters pertaining to the redemption is final and no correspondence will be entertained. We reserve the right, at any time without giving reason or notice to vary Terms and Conditions, or terminate the redemption programme.

6.1 The ComfortPoints earned in a calendar year will expire on 31 January the following year. Thereafter, such ComfortPoints shall immediately be forfeited. The Company may from time to time, without notice, amend the validity period of the ComfortPoints.

6.2 Upon expiry and/or earlier termination of the Account for whatsoever reason, any unconsumed ComfortPoints shall be simultaneously forfeited.

Notwithstanding and without prejudice to Clause 9 and all other Terms and Conditions contained herein, the Company shall be entitled at any time or from time to time in its absolute discretion without liability to the ComfortPoints member, without notice and without giving any reason whatsoever, to:

8.1 Suspend or terminate or vary the ComfortPoints member’s right to participate in the Programme entirely or in respect of specified facilities, whether or not the ComfortPoints member is in default of the Terms and Conditions herein;

8.2 Introduce, vary, restrict, suspend or terminate the Programme or any or all of the benefits, services, facilities and privileges in respect of, or in connection with, the Programme.

9.1 The Company may at its sole discretion, without notice to the ComfortPoints member, decline to issue any ComfortPoints and/or suspend indefinitely or terminate the Programme.

9.2 The Company may at its sole discretion and decision, cancel any remaining ComfortPoints in the account and/or suspend or terminate a ComfortPoints member’s account in the Programme without notice if any one or more of the following shall occur or deemed to have occurred in the sole opinion of the Company without assigning any reason(s) thereto:-

    • 9.2.1 abuse of or attempted abuse of the Programme in any manner whatsoever by the ComfortPoints member;
    • 9.2.2 any fraud committed and/or misrepresentation of any information supplied or to be supplied by the ComfortPoints member;
    • 9.2.3 the use or attempted use of the Programme in a manner contrary to the Terms and Conditions contained herein;
    • 9.2.4 any suspicion of dishonesty on the part of the ComfortPoints member in connection with the Programme;
    • 9.2.5 any display of inappropriate behaviour of the ComfortPoints member against any of the Company’s employees and/or servants and/or agents;
    • 9.2.6 any person or entity whom the Company deems to be a wholesaler and/or distributor.

10.1 The Company disclaims any liability whatsoever arising from or relating to the awards and/or redemption in the Programme.

10.2 Any disputes about quality performance of the redeemed products and services should be resolved directly with the merchant. We shall not be liable whether directly or indirectly for any damage, injury, loss whatsoever, howsoever incurred or suffered to a person as a result from the redeemed products or services.

10.3 Notwithstanding any other Terms and Conditions herein, the Company shall not be liable to the ComfortPoints member or any third party for any loss (whether direct or indirect), damage, inconvenience, embarrassment, cost and expense of any nature which in any way may be suffered (or to be suffered) or incurred (or to be incurred) by the ComfortPoints member or by any third party in respect of or in connection with the participation in the Programme.

10.4 The Company will not be liable if it is unable to perform its obligations under this Programme due directly or indirectly to the failure of any machine or communication system, industrial dispute, war, Act of God, or anything outside our control or the control of the Company’s merchants or agents or Partners or Service Providers, including without limitation, the loss of all data and records pertaining to the Programme or to the account.

10.5 The ComfortPoints member shall hold the Company harmless and keep the Company fully indemnified from and against all loss and damage directly or indirectly arising from or relating to the ComfortPoints member’s misuse of the Programme and/or breach of these Terms and Conditions, suffered (or to be suffered) or incurred (or to be incurred) by the Company.

The Company may, whenever it consider it in its interest, at any time and from time to time and without liability nor notice to the ComfortPoints member, disclose to any third party or use any information in relation to the ComfortPoints member as the Company deems fit and in the Company’s absolute discretion, including, without prejudice to the generality of the foregoing, its Service Providers, servant, agents, correspondents, and/or independent contractors, any of the government agency, statutory board or authority in Singapore or elsewhere and any other person to whom it consider in its interest to make such a disclosure.

12.1 The Company may vary and/or amend these Terms and Conditions, at any time and from time to time, without notice to the ComfortPoints member.

12.2 The Company’s decision to all matters concerning the Programme and/or the participation of any ComfortPoints member in the Programme is final and no correspondence will be entertained. In the event of any dispute, the Company’s decision is final and conclusive.

12.3 No failure to exercise or no delay by the Company in exercising any right or remedy under this Terms and Conditions will operate as a waiver of such right or remedy, nor will any single or partial exercise of any right or remedy preclude any other or further exercise of such right or remedy or the exercise of any other right of remedy.

12.4 ComfortPoints members shall be deemed to have read, understood, and accepted these Terms and Conditions.

12.5 The Terms and Conditions herein may be translated into any other languages. In the event of any inconsistency, the English version shall always prevail without exception.

12.6 These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Republic of Singapore. ComfortPoints members participating in the Programme hereby irrevocably submit themselves to the jurisdiction of the courts of the Republic of Singapore.
